Tehama County Probate Rules

Section 5, Rule 23 of the Tehama County Local Rules provides guidelines for probate cases filed in Tehama County. In this regard, you should be aware that Tehama County has elected to rely on California State laws and rules and has not created local rules applicable to Tehama County probate cases at this time.

Adjudicated Newspapers for Tehama County

How to File Probate in Tehama County

Probate involves the court-supervised process of administering the contents of a deceased person’s estate. During the probate process, the personal representative will be responsible for paying any outstanding debts and taxes before distributing any remaining assets to beneficiaries and heirs. A personal representative can usually complete a routine probate case within a year of filing.

To file probate in Tehama County, you will first need to prepare and submit the probate petition at the court clerk’s office in Red Bluff. If the decedent had a will, you must lodge it with the court at the same time you file the Petition. Once you file the probate petition, the court will schedule a hearing. You will also need to provide notice to all interested parties as soon as you file a probate petition. In addition, you will need to complete publication of the notice in a legally adjudicated newspaper for Tehama County,

If the court approves the Petition, the court will issue Letters Testamentary to the Executor or Letters of Administration to the appointed Administrator at the conclusion of the hearing.

There are many steps that the personal representaative will have to take to successfully complete a probate in Tehama County. For excample, during the probate process, the estate’s administrator will have to notify all interested parties (creditors and beneficiaries) of the probate estate assets. In addition, the personal representative must pay all outstanding taxes and debts before they can distribute the assets to beneficiaries. Four months after the Court issues Letters, the personal representative can file a Petition for Final Distribution and ask the court permission to distribute all remaining assets to beneficiaries and heirs.
