Despite common belief, you do not need to hire an attorney to probate an estate in California. Attorneys charge statutory probate fees to probate the decedent’s estate. The attorney receives a percentage of the gross value of the estate’s value. The amount of work an attorney is required to perform to complete the probate case, unfortunately, is not related to the fee the attorney will receive. In this regard, an attorney will receive a higher rate for the decedent’s probated estate valued at $900,000 in comparison to $700,000 despite investing less time and effort into the matter.
