For example, if the estate consists of a $500,000 house but the house has a $480,000 mortgage, the statutory attorneys fees would be calculated on the full $500,000 value. Attorneys fees would be calculated as follows:

4 percent of first $100,000: $ 4,000.00
3 percent of next $100,000: $ 3,000.00
2 percent of next $800,000: $ 6,000.00

Total attorney fees would be $11,000.00.

For an estate valued at $250,000, the attorney’s fees would be $8,000. In addition to these fees, there are ancillary third-party costs such as court filing fees, newspaper publication fees and appraisal fees which typically add about $1500 or more to the total cost of probate.
