First, to take advantage of the California one day divorce program you must have already filed the divorce case and served your spouse. Later on in this article, we will address other criteria in greater detail. How the One Day Divorce Program in California Works

Most importantly, California’s one day divorce program is for self-represented parties. As mentioned above, the divorce case must already be filed. Furthermore, the parties must complete and exchange their preliminary financial disclosures. In other words, the divorce case must be ready for a final judgment. In this regard, a divorce case is ready for judgment only once all the following conditions are satisfied:

  1. The Petitioner has served the Respondent with the summons and complaint.
  2. The Petitioner has filed a Proof of service of summons with the court, or the Respondent has filed a Response.
  3. Each party filed a recent income and expense declaration with the court.
  4. Both parties agree on all pending divorce issues such as child custody, child support, the division of property, or spousal support.

The Respondent can only participate in the one day divorce program with the Petitioner.

Income Criteria for One Day Divorce Participants

In addition to meeting the criteria above, depending on the jurisdiction in which the parties reside, both parties must meet income guidelines to be eligible for the one day divorce program. For example, in Sacramento, a household of two must earn less than $2,707 per month to qualify for the program. The program focuses on providing low-income spouses resource for a speedy divorce.

Most courts allow parties to sign up online for this service. New attorneys, supervised by senior attorneys, will help parties in the process.  Most Courts hold their one day divorce clinics once a month for parties to attend.
